These general conditions of use and legal information (hereinafter, General Terms) apply to the website of Webelapp Technologies, S.L. (hereinafter referred to as Webel), whose domains are appwebel.com and webel. es, and the corresponding mobile application, as well as all related or linked sites from appwebel.com and webel.es by Webel (hereinafter, collectively, the ‘Site’). The Site is owned by Webel. By using the Site, the User agrees to these terms of use. If you do not agree, please refrain from using it.
By means of these General Terms, Webel makes the website and the Webel mobile application (hereinafter jointly referred to as the Platform) available to users (hereinafter referred to as User or Users).

Webel is a technology company that develops and operates a digital platform for the intermediation and management of services. The Platform allows clients interested in booking a service to connect with professionals who independently choose to advertise the services they offer.
Professionals freely choose the categories in which they wish to advertise and define the content, scope, price, availability, service areas and other conditions of their services. The available categories and features serve exclusively technical and marketplace-organisation purposes and do not determine how each service must be performed in practice.
The client browses the listings and freely chooses the professional they prefer. Webel does not select or assign professionals, does not guarantee any volume of bookings and does not participate in the client’s decision.
When the professional accepts a request or the client accepts a proposal, the contract is entered into directly between them. Webel is not a party to that contract, does not provide the service and does not direct or control its performance.
Access to the Platform and the voluntary creation of a profile by the User implies the express and unequivocal acknowledgment and acceptance of these General Terms, the Privacy Policy, the Cookie Policy, and the Terms of Use of the payment provider(s) by all Users.
To become a User of the Platform, the following requirements must be met:

The User guarantees that all data provided to Webel regarding their identity and legitimacy in the Platform's registration forms are truthful, accurate, and complete. The User also agrees to keep their information updated, being solely responsible for any false or inaccurate data.
In the event that the User provides any false, inaccurate, or incomplete information, or if Webel has reasonable grounds to doubt the truthfulness, accuracy, or completeness of such information, Webel may deny the User present or future access to and use of the Platform or any of its content and/or services.
Upon registering on the Platform, the User will be able to access their profile by entering their email address and the password set during registration. Both the email address and password are strictly confidential, personal, and non-transferable. Webel recommends not using the same passwords as on other platforms to enhance account security. In the event that the User uses the same login credentials as on other platforms, Webel cannot guarantee the security of the account or ensure that the User is the only one accessing their profile.
The User agrees not to disclose their account information or make it accessible to third parties. The User will be solely responsible for the use of such information or the services of the site by third parties, including any statements made on the Platform, or any other actions carried out using the username and/or password.
3.1. Profile
To complete the registration on the Platform, the User must provide the following mandatory information: first name, last name, and email address; and optionally provide additional information such as date of birth, phone number, or ID. Once registration is complete, the User will be able to access their profile and complete, edit, or delete it as they see fit.
When a User registered as a Client requires a service, they may access the platform and select the service they wish to contract, either through the available shortcuts or the platform's search bar. Once accessed, the Client must enter the address where they want to receive the service, so that the available Professionals in that area are displayed.
The Client may choose from the Professionals available in their area by accessing their profiles, which include a personal description, the final price list for each service, their availability, and reviews from other Users. The Client will freely select the Professional they deem appropriate, with Webel bearing no responsibility for the Client's choice of such Professional.
Once a request has been sent, the professional may freely accept or decline it. If it is not accepted within the period indicated on the Platform, the request will expire automatically, with no obligation to accept the service.
Acceptance creates a contract exclusively between the client and the professional, subject to the conditions agreed between them. From that moment, each party will be responsible to the other for fulfilling the obligations they have assumed. Webel will not be a party to that contractual relationship.
If the service cannot begin at the agreed time because either party is unavailable, the client and professional may freely agree on a new time, date or other solution.
If the client is not at the agreed address, the parties may decide how to proceed. If they do not reach an agreement, once 30 minutes have elapsed from the scheduled time, the client will be deemed absent solely for the purpose of applying the financial consequences set out in the Cancellation Policy. This rule does not determine how the professional must organise their time or require them to accept a change to the service.
If the professional becomes unavailable, they may cancel the service or propose an alternative to the client. The client will be free to accept or decline it.
4.1 Service Provision
Users who choose to offer their services through the Platform and, therefore, become Professionals, must complete a questionnaire where they specify the services they offer. In doing so, they must indicate the city and areas where they wish to provide the service(s), the price, service details, and a detailed description. The Professional confirms that the information provided is correct, accurate, and truthful, and will be solely responsible in case of any dispute. Listings cannot be duplicated, and the Professional may advertise in all professional categories available on the Platform.
The professional uses the Platform on their own account and acts at all times in their own name and interest. The relationship between Webel and the professional is limited to the provision of technological intermediation and marketplace-management services and does not constitute an employment, agency, partnership, representation, dependency or exclusivity relationship.

Webel does not impose schedules, working hours, minimum activity levels, billing targets, minimum acceptance rates or instructions regarding the practical performance of the service. Nor is there any exclusivity or non-compete obligation.
Each user will be responsible for determining and complying with the tax, employment, contractual and Social Security obligations applicable to their circumstances and to the services they book or provide.
Where an employment relationship exists between the client and the person providing the service — including, where applicable, the Special System for Domestic Workers — the obligations relating to engagement, registration, contributions, payment of wages and all other responsibilities will rest exclusively with the parties to that relationship.
Where the professional operates as a self-employed person, company or through their own organisation, they will be responsible for their registrations, declarations, invoicing, staff, collaborators, insurance and other obligations. Webel will not be the employer or contracting party, without prejudice to any duties imposed on the Platform by law.
Once the service is completed, it is the Professional's responsibility to provide a physical receipt for the service if requested by the Client, with the Client and Professional being the sole parties responsible under the contractual relationship.
4.2 Ranking, levels and listing visibility
The Platform may rank listings using objective, predefined criteria related to the information in the listing, activity recorded in the marketplace, displayed availability, client reviews and the outcome of bookings made through Webel.
Levels, scores and visibility rules apply to each listing and are used solely to organise its position in search results for new clients. They do not constitute an employment assessment of the person and do not determine how they must provide their services.
The main criteria will be available to the professional. Their effects will be automatic and reversible when the data changes. A listing’s position does not prevent the professional from working outside Webel or from being hired by previous or independently acquired clients.
Significant visibility restrictions, suspensions or account closures will be communicated with a statement of reasons and may be challenged and subject to human review.
When an issue arises, the client and professional may try to reach an agreement directly. If they are unable to do so, either party may request Webel’s mediation.
Webel will act as a third-party intermediary and will review only how funds processed through the Platform should be allocated, in accordance with the published policy, the information provided and the substantiated circumstances.
This intervention does not make Webel a party to the contract and does not constitute a disciplinary assessment of the professional. The parties may submit representations, and the decision will be subject to human review.
If the professional does not attend at the agreed date and location, the client may report the issue and request the applicable refund under the Cancellation Policy.
The client may carry out a new search and freely choose another professional from the available listings. Webel will not assign replacements or assume responsibility for providing the cancelled service.
Signing up and accessing the Platform is entirely free for Users.
The client will pay the professional the agreed price using the infrastructure of the payment provider integrated into the Platform. The payment will be associated with the professional’s payment account in accordance with the provider’s terms.
Webel does not remunerate the professional or pay the price from its own bank account. Its role is to integrate the system technically and apply the objective rules governing the availability of funds, linked to completion of the service, the claim period and technical processing times.
Depending on the type of service, the Professional will either set an hourly rate, which will be multiplied by the duration of the service to calculate the total, or a flat rate per service, in which case the price established for each service will become due. It is the sole responsibility of the Professional to set the amount they wish to receive for providing the service, as it is the responsibility of the Client to pay the agreed price once the service has been rendered.
All prices indicated on the Platform must include any applicable taxes based on the territory in which the User operates and shall be expressed in the prevailing currency according to the territory of the User's operation, with the euro (€) as the default currency.
In accordance with Clause 6 above, the applicable prices for each service shall be those published on the Platform by the Professional at the time of booking. These prices may include, in addition to the fee set by the Professional, a commission charged by Webel for the use of the Platform, which may be displayed either as a separate item or included within the total amount payable by the Client. The professional will invoice the client where required. Webel will charge the applicable fee for use of the Platform, as disclosed before the booking. This fee is not salary in nature and does not constitute a deduction from remuneration paid by Webel.
The Professional may modify the price of their services through the designated section in the application; however, this price will not affect services that have already been booked or contracted beforehand.
8.1 Messaging Service
The messaging service is intended to facilitate communication relating to services booked, or intended to be booked, through Webel. It may not be used to send illegal, fraudulent, offensive or malicious content, or content intended to circumvent fees applicable to a booking originating on the Platform.
Webel may use automated systems to detect messages that may breach these rules. The message may be blocked, and the user will be informed of the reason. In the event of serious or repeated breaches, Webel may proportionately limit the affected feature or temporarily restrict the account.
These rules are limited to the use of Webel and do not prevent the professional from having their own clients or working outside the Platform. Significant restrictions may be reviewed.
8.2 Reviews
Users are entitled to write reviews/ratings only if a service has been contracted between them via the Platform. Such reviews must be honest and fair, and insults and falsehoods are prohibited.
Webel may remove reviews or content that breach these Terms, are false, contain insults, infringe third-party rights or are unlawful. Wherever possible, the measure will be limited to the affected content.
Features or the account may be restricted only where necessary and proportionate in view of the seriousness or recurrence of the breach. Webel will communicate the reason and provide a review channel, except in urgent cases involving security, fraud or legal compliance.
